The car sped up and slowed down several times while weaving across the center line when Lindsey initiated a traffic stop. The car traveled another quarter of a mile before stopping in the middle of the outside lane before moving the car to the shoulder of the road.

Lindscy approached the car and said he could smell alcohol coming from the vehicle. Lindsey asked the driver, later identified as Orlando Santiago, 23, of Batesville for his license. Santiago told Lindsey he didn't understand. Lindsey then asked Santiago for his license in Spanish, and again Santiago told him he didn't understand. Santiago was arrested for suspicion of driving under the influence of alcohol, and two passengers who could not speak English but also appeared to be drunk were taken to the Independence County jail.

Santiago was given a blood- alcohol breathalyzer test which registered .09. The legal limit in Arkansas is .08. Santiago was cited for driving under the influence, not having a driver's license and driving left of center. Just after midnight Saturday, Deputy Wayne Green Jr. saw a Chevrolet pickup at the old ferry crossing at the Oil Trough access to the White River.

Green went to check on the people in the pickup and said he could smell alcohol. The driver, Virgil W. Holderby, 41, and his passenger, Susan E. McKibben, 37, both of Oil Trough, told Green they were just looking at the river. Holderby admitted he had drank four or five beers earlier.

Green was given permission to look inside the vehicle, where he found a partially smoked marijuana cigarette. Green asked the couple if there was anything else in the pickup. McKibben told Green she had about a quarter ounce of marijuana with her but Holderby didn't know anything about it. Holderby was given a portable blood-alcohol test that registered .85. McKibben was placed under arrest and charged with possession of marijuana and no proof of liability insurance.

Holderby was arrested and charged with public intoxication.
